رأی شورای رقابت به نفع بیمه مرکزی / آمیتیس نقطه اتصال شرکت‌های بیمه به کارگزاری‌های آنلاین شد
تیر ماه سال گذشته سه شرکت تجارت الکترونیک نوین نار، سرمایه سازان کامیاب امین و آریا پرداز رایکا، بابت ایجاد انحصار و ارتکاب رویه‌های ضدرقابتی از بیمه مرکزی شکایت کردند. اکنون بعد از یکسال شورای رقابت این شکایت را رد و به نفع بیمه مرکزی رای داده است. براین اساس آمیتیس سهامدار عمده بیمه مرکزی به عنوان تنها نقطه اتصال هوشمند شرکت‌های بیمه با کارگزاری‌های برخط و سایر استارتاپ‌های خدمات‌دهنده معرفی شد.
طبق آئین نامه شماره ۹۲ بیمه مرکزی شرکت‌های کارگزاری برخط را موظف کرد که سرویس‌های API بیمه‌ای خود را از طریق سوئیچ بیمه اخذ کنند و شرکت «راهبرد نگار آمیتیس» به‌عنوان مجری این پروژه -که عمده سهام آن متعلق به بیمه مرکزی است- مجاز به ارائه این خدمات شد. اما شرکت‌های بیمه‌ای نسبت به این موضوع اعتراض داشتند تا جایی که تیرماه سال گذشته سه شرکت عمده کارگزار برخط بیمه که سهم بالایی در فروش آنلاین بیمه دارند، در این باره در شورای ملی رقابت اعلام شکایت کردند. این سه شرکت معتقدند که ارائه سرویس API انحصاری است. اما حالا با گذشت بیش از ده ماه از اعلام این شکایت شورای رقابت به نفع بیمه مرکزی رای داده و اعلام کرده است که راه‌اندازی سوئیچ بیمه توسط شرکت آمیتیس فقط محدود به ایجاد شبکه ارتباطی است و منجر به انحصار نخواهد شد.
بنابر اعلام شورای رقابت، فعالیت شکات در فروش آنلاین که کارگزاران برخط از طریق سوئیچ بیمه از سرویس‌های فروش بیمه شرکت‌های بیمه استفاده می‌کنند، الزام بیمه مرکزی و در راستای اجرای صلاحیت‌های نظارتی است. اینکه تمامی شرکت‌ها و فعالان بیمه‌ای فعالیت‌های خود را از طریق این سامانه انجام دهند با انحصار و ارتکاب رویه‌های ضدرقابتی یکسان نیست.
شورای رقابت که سوئیچ را بستری برای تسهیل ورود به بازار بیمه معرفی کرده، در این رأی عنوان کرد: «اقدام بیمه مرکزی در اجرای سامانه سوئیچ بیمه‌ای برای نظارت بر عملیات و فعالیت‌های بیمه‌ای از طریق ایجاد شبکه ارتباطی بین بیمه مرکزی، شرکت‌های بیمه و کارگزاران رسمی برخط بیمه و تبادل اطلاعات دراین‌خصوص باهدف تنظیم و نظارت بر این بخش در راستای عمل به وظایف و اختیارات نهاد ناظر وفق قانون تأسیس بیمه مرکزی ایران و بیمه‌گری (مصوب ۱۳۰۵) و آیین‌نامه‌های مربوط (آیین‌نامه کارگزاری رسمی بیمه مستقیم، شماره ٢/٩٢ مصوب شورای‌عالی بیمه) ارزیابی می‌شود.
و این بدان معنی است که سامانه سوئیچ بیمه‌ای صدور بیمه‌نامه و دریافت حق بیمه توسط شرکت‌های بیمه‌ای یا نمایندگی‌های آنها انجام‌گرفته و بازاریابی و فروش بر خط بیمه‌نامه برای شرکت‌های بیمه‌گر یا نمایندگان آنها توسط کارگزاران برخط صورت می‌گیرد و بیمه مرکزی به‌عنوان مرجع ناظر حوزه بیمه، تنظیم‌گری و نظارت را برعهده داشته و لذا اقدامات آن در تشکیل و راه‌اندازی سوئیچ ارتباط ماهیتی و ملازمه‌ای با عملیات بیمه‌گری و صدور بیمه‌نامه ندارد.»

موضوع مورد انتقاد دیگر در این شکایت انتخاب شرکت راهبرد نگار آمیتیس به‌عنوان مجری سوئیچ بیمه‌ای، بود. شورای رقابت با تاکید براینکه سامانه سنهاب بیمه مرکزی به اذعان نهادهای امنیتی یکی از سامانه‌های بااهمیت بالا و حساس کشور محسوب می‌شود و اطلاعات موجود در آن باید به طور ویژه صیانت شود. در این باره اظهار کرد: «طراحی و نگهداری سیستم سوئیچ را به شرکت راهبرد نگار آمیتیس برون‌سپاری شده است. در این موردنظر به لزوم حفظ حقوق بیمه‌گذاران، شرکت‌های بیمه و دیگر فعالان این حوزه و ضرورت حفاظت از اطلاعات موجود در زیرساخت فناوری اطلاعات بیمه مرکزی و تأمین محرمانگی آن که برابر شواهد و قرائن موجود ادعای مشتکی‌عنه دراین‌خصوص نیز مقرون به صحت به نظر می‌رسد و در نتیجه پیمانکار سوئیچ بیمه مرکزی باید منطقاً مورد وثوق و تحت نظارت تام و مستقیم ناظر و تنظیم‌گر این بخش باشد؛ بنابراین انتخاب شرکت راهبرد نگار آمیتیس و واگذاری راه‌اندازی و پشتیبانی سیستم سوئیچ به آن (که طبق ترکیب سهام‌داری، وابسته به بیمه مرکزی و تحت کنترل و نظارت آن ارزیابی می‌شود) موجه و مطابق موازین و ترتیبات مذکور است.»
شورای رقابت در پایان رای اعلام کرده که ین تصمیم ظرف مدت بیست روز از تاریخ ابلاغ به ذی‌نفع قابل‌تجدید نظرخواهی در هیئت تجدیدنظر موضوع ماده ۶۴ این قانون خواهد بود.
